In this paper, we contend that the “Smith case” in Gettier’s attempt to refute the justified true belief (JTB) account of knowledge does not work. This is because the said case fails to satisfy the truth condition, and thus is not a case of JTB at all. We demonstrate this claim using the framework of Donnellan’s distinction between the referential and attributive uses of definite descriptions. Accordingly, the truth value of Smith’s proposition “The man who will get the job has (...) ten coins in his pocket” partly depends on how Smith uses the definite description “the man who will get the job” when he utters the proposition. Since, upon uttering the proposition, Smith has in mind a particular individual, namely Jones, and not just whoever will fit the attribute specified in the definite description, Smith uses the definite description referentially. And so when it turns out that it is Smith who eventually gets the job, the definite description fails to refer to Jones as intended by Smith, thereby making Smith’s proposition false. To think that Smith’s proposition is still true, in this regard, is to use the definite description attributively—that it is about whoever will fit the definite description. Apparently, when Gettier claims that Smith’s proposition is still true, to demonstrate that it is a case of JTB, he, in effect, imposes his attributive understanding of Smith’s usage of the definite description on Smith’s own epistemic situation. For instance, the French news magazine Le Point published (...) an article on it called “How Saint Thomas Justifies Homosexuality.” This perception is bolstered by the cover artwork of Saints Sergius and Bacchus, who are considered in some circles to be patron saints of homosexual love. In fact, the book has two distinct parts. The first part is entirely on marriage between persons of the opposite sex. Oliva argues that Thomas Aquinas’s teaching on marriage was obscured in the nineteenth century, reappropriated by the Second Vatican Council, and now can be used to justify the reception of Communion and sacramental penance by Catholics who divorce and remarry while their spouse is still living and their marriage is not annulled. Only in the second part of the book does Oliva argue for the civil and ecclesiastical recognition of homosexual unions that are not marriages.The book is addressed to a general audience, although it refers to scholarship when needed. Oliva’s purpose is to use Thomas to contribute to contemporary theology and pastoral care. He does not entirely reject magisterial teaching on sexual ethics. For instance, he sympathetically discusses the treatment of heterosexual sex in Humanae vitae, and is generally opposed to simultaneous sexual relationships that are between more than two persons.In the first part of the book, Oliva notes that for Thomas marriage has a twofold perfection. The first perfection consists in the union of the spouses (which need not involve sexual acts), and the second in the generation and education of children. According to Oliva, only the first perfection is essential to marriage, which is shown by the fact that a marriage is valid even if the spouses voluntarily choose to abstain from the sexual act. Oliva eventually argues that recognition of this point should lead to the acceptance of second marriages (i.e., marriages after divorce) and the recognition that circumstances might prevent sexual acts in such marriages from being sinful.According to Oliva, Thomas’s understanding of the essence of marriage was used by the Fathers of the Council of Trent in what he describes as a decision to avoid the condemnation of divorce and remarriage for those in the Christian East. This interpretation of Trent is highly questionable and seems to rely partly on Giancarlo Pani’s recent popularization of Piet Fransen’s controversial scholarship (147 n. 41). In fact, Oliva does not show how Thomas’s understanding of marriage was supposedly used against those who wished to condemn divorce and remarriage. In general, he ignores the Council of Florence and various medieval and late Scholastic discussions of marriage, and generally passes over theologians from outside the Dominican Order. [End Page 137]Oliva correctly notes that the Catechism of the Council of Trent follows Thomas in distinguishing between three motives or ends of marriage, namely, society and mutual support, procreation, and the remedy for concupiscence. He passes over the other motives discussed in the Catechism, such as beauty, wealth, and the desire for heirs. Moreover, he does not mention the Catechism’s discussion of the three goods of marriage, namely, union, children, and fidelity, and how these might be related to marriage’s motives and essence. This oversight is odd because the Catechism’s treatment resembles Thomas’s discussion in the Summa contra Gentiles, book IV, chapter 78, in which Thomas explains how marriage is ordered to procreation. Although Health Care Ethics approaches the topic from a theological perspective, using scriptural passages as well as broader religious themes and contexts, the book is accessible to those outside of the religious arena as well.The first three chapters lay the framework for general theological and ethical inquiry while the later chapters discuss more specific topics in applied health care ethics. The opening chapters by Michael Panicola are thought-provoking, especially since they encourage readers to participate in exercises to determine how they would respond to particular scenarios in their personal decision making. YoffieThe case of Johannes Cocceius defies the commonplace that Leiden University (and perhaps post-Reformation, confessionalized Europe in general) turned away from humanist scholarship in the first quarter of the seventeenth century. In 1650 Cocceius (1603-69), a Bremen-born Oriental philology professor at Franeker, joined the Leiden theological faculty and wrote a treatise, Protheoria de ratione interpretandi sive introductio in philologiam sacram (De ratione). He (...) praised such rabbinic exegetes as Rashi (1040-1105) and David Kimchi (ca. 1160-ca. 1235) in humanist terms for their erudition. At the same time the "new" Cartesian philosophy was taking hold in the arts faculty, and mathematics instruction was encroaching on scholastic formal logic.1 Leiden would become famous for Cartesianism, mathematics, and "Calvinist Copernicanism" in the second half of the seventeenth century, but Cocceius still worked in the tradition of advanced humanist scholarship that had made the institution famous in the sixteenth century.2Leiden's earlier reputation was due in large part to the biblical humanist work of such Renaissance polymaths as Joseph Justus Scaliger (1540-1609) and Hugo Grotius (1583-1645), but by Cocceius's time Leiden theologians were subject to greater Church and State control. As Jonathan Israel and Edwin Rabbie have shown, in response to the controversy that surrounded Jacobus Arminius and his stand on predestination, the Synod of Dordrecht (Dort) drafted an anti-Arminian statement in 1619; any professor who did not sign was subject [End Page 383] to exile from the republic in addition to dismissal from his post.3 Innovative theology, exegesis, and philology suffered as professors, fearing State and Church reprisals, turned to "dogmatic humanism." As Henk Jan de Jonge has explained, this meant that "almost all the theologians of seventeenth-century Leiden who concerned themselves with the explanation of the New Testament placed exegesis at the service of dogmatic objectives."4 Unlike his fellow Leiden theologians, Cocceius pursued biblical humanism and Christian Hebraism through the study of Hebrew, Greek, and Aramaic-and he did so in a unique way. He was not the first to use Jewish commentaries and even Jewish post-biblical literature for the purpose of reconstructing the original Hebrew Bible, but he was innovative in praising rabbinic scholars as fellow humanists and in incorporating their scholarship into his Christological exegesis and philosophy. He did so, furthermore, not as an independent scholar or pastor or even as a professor of Hebrew; but as the holder of a university chair in theology at a confessionalized university in a century hostile to his brand of late humanism.Although he came to Leiden as a theologian, Cocceius had impressive training as an Orientalist. He had studied with the famous scholar Sixtinus Amama (1593-1629) and polished his Hebrew and Aramaic by working with a Jewish tutor from Hamburg.5 While still a student at Franeker, Cocceius wrote a translation and commentary of the Talmudic tractate Sanhedrin. A few years later he began composing commentaries on the Pentateuch, and, by the time he arrived at Leiden, he had completed one lecture, series of lectures, or piece of writing on every book of the Old Testament. These commentaries were based not only on Cocceius's extensive knowledge of Oriental languages but also on his readings of medieval Jewish commentators. These were the same commentators that Cocceius would later praise in chapter eight of the De ratione.These humanist achievements were much at variance with Cocceius's public persona as perhaps the most prominent Dutch Calvinist theologian of the seventeenth century. For approximately 100 years after his death in 1669 a faction of Leiden theologians calling themselves "Cocceians" battled the "Voetians," followers of Gisbertus Voetius, for the soul of the Dutch Church.6 At Leiden he lectured on the Pauline Epistles, a typical subject for a seventeenth-century Calvinist theologian, and he worked on his famous theological tract, the salvation-historical Summa doctrinae de foedere et testamento Dei (1648). Some versions of structuralism consider actors to be necessary for structural analysis; others argue that they are not. All versions of structuralism consider social structure to be analytically independent of actors. I show through examples and subsequently through deduction that this position is wrong. That is, any conceptualization of social structure necessarily involves a conception of its constituent actors. Moreover, I generalize this point to argue that the structure of scientific knowledge follows a multilevel modeling approach: theory at every level (...) of aggregation is based on actor models of appropriate units. Several practical benefits result from using actor models explicitly in structural analysis in particular, and from following the multilevel modeling approach in general. (shrink)

The Bush administration's military war on terrorism is a blunt, ineffective, and unjust response to the threat posed to innocent civilians by terrorism. Decentralized terrorist networks can only be effectively fought by international cooperation among police and intelligence agencies representing diverse nation‐states, including ones with predominantly Islamic populations. The Bush administration's allegations of a global Islamist terrorist threat to the national interests of the United States misread the decentralized and complex nature of Islamist politics. Undoubtedly there exists a “combat fundamentalist” (...) element within Islamism. But the threat posed to U.S. citizens by Islamist terrorism neither necessitates nor justifies as a response massive military invasions of other nations. Not only does the Bush administration's war on alleged “terrorist states” violate the doctrine of just war, but in addition these wars arise from a new, unilateral, imperial foreign‐policy doctrine of “preventive wars.” Such a doctrine will isolate the United States from international institutions and long‐standing allies. The weakening of these institutions and alliances will only weaken the ability of the international community to deter terrorism. (shrink)

Goering and colleagues (2017) acknowledge closed-loop neural devices have the potential to undermine agency. Indeed, the authors observe that “the agent using the device may . . . sometimes doubt whether she is the author of her action, given that the device may operate in ways that are not transparent to her” (65). Still, the authors ultimately argue that closed-loop neural devices may be construed as supporting agency, especially when we view agency from a relational perspective. The reason? We often (...) manifest our agency in relation with others. For example, family and close friends sometimes step in to support us in setting and achieving our aims. In a similar way, then, the authors argue that “we can imagine [a closed-loop] device stepping in to support the user in achieving her aim” (67). Closed-loop neural devices, in other words, can be construed as supporting one’s agency in much the same way as other people can be seen as supporting one’s agency. The authors thus conclude that when we view agents from a relational perspective, closed-loop neural devices may be viewed as supporting rather than undermining agency. I largely agree with the authors’ conclusion. I also believe, however, that their discussion can be clarified by distinguishing three kinds of agency and viewing closed-loop neural devices from the perspective of each. By thinking carefully about agency, we can see more clearly the ways in which it is undermined by closed-loop neural devices, as well as the way in which these devices may support agency. (shrink)

Recent research in moral psychology highlights the role of emotion and intuition in moral judgment. In the wake of these findings, the role and significance of moral reasoning remain uncertain. In this article, we distinguish among different kinds of moral reasoning and review evidence suggesting that at least some kinds of moral reasoning play significant roles in moral judgment, including roles in abandoning moral intuitions in the absence of justifying reasons, applying both deontological and utilitarian moral principles, and counteracting automatic (...) tendencies toward bias that would otherwise dominate behavior. We argue that little is known about the psychology of moral reasoning and that it may yet prove to be a potent social force. (shrink)

This paper develops analogies concerning the evolution of dissipative structures in nonequilibrium thermodynamics to interpret irrational human behavior in which one finds a lack of correspondence between the invested means and the consequences observed. In an attempt to positively explain the process of cooperation between the free human person and interacting God, I use philosophical categories of Whitehead's process philosophy in an aesthetic model that opposes composition and performance in a musical symphony. Certainly, the essence of human freedom can be (...) expressed in neither thermodynamical nor aesthetic terms. The models proposed can, however, facilitate our understanding of the mutual relations between God's action in the world and the drama of human free choice of moral evil. (shrink)

When I say ‘pain’, it is clearly a singular phenomenon. Yet if I ask for an example, you can provide many varying instances that confound the idea of its singularity. How can a pinprick be of the same thing as depression or grief? This study maintains the singularity of pain by exploring the process and structure of its experience to account for its variance and its subjectivity. Heidegger’s Being and Time provides the pathway to achieving this, where we comprehend how (...) pain’s myriad manifestations, and their inherent subjectivity, relate to our way of Being – the meaningful horizon through which we encounter pain. The study comes to tie the process of encountering pain with a structure that suffering provides, which explains both the variance and the subjectivity of the pain experience. This can then be mapped onto individual experiences of a singular phenomenon to understand how they arose and what has conditioned them. (shrink)

One of the chief problems of the American environmental movement is the definition of philosophy—the exploration, examination, and elucidation of ideas—of the many different causes that have been combined in it. In this book Joseph Petulla sorts out the various issues and concepts of environmentalism by tracing their inspiration and values from the three traditions of environmental thought—the biocentric, the ecologic, and the economic. He examines the movement's historical roots, assumptions, goals, values, politics, struggles, successes, limitations, trends, and, finally, (...) the priorities it has brought to the national consciousness. This disentangling, clarifying process involves political implications and judgments about the recent directions of the environmental movement. Absolutist assumptions and methodologies often lead environmentalists and their opponents into conflict, yet even conflict groups must live with each other in the natural world, and that natural world must be understood by reason. Are conspiracy theory beliefs pathological? That depends on what is meant by "pathological." This paper begins by unpacking that ill-defined and value-laden term before making the case that widespread conspiracy theory belief should not be conceptualized through the “othering’ perspective of individual psychopathology. In doing so, it adopts a phenomenological perspective to argue that conspiracy theory beliefs can be reliably distinguished from paranoid delusions based on falsity, belief conviction, idiosyncrasy, and self-referentiality. A socio-epistemic model is then presented that characterizes the (...) broader phenomenon of conspiracy theory belief as a product of a sick society plagued by epistemic mistrust and vulnerability to misinformation that is ubiquitous in today’s post-truth world. Finally, it is proposed that for individuals, the harmfulness of conspiracy theory belief is less related to belief content as it is to belief conviction and degree of self-relevant consequentiality. Staging conspiracy theory belief in terms of ideological commitment offers a conceptual framework to estimate behavioral risks and test hypotheses about the effectiveness of interventions along a continuum of belief conviction and associated socio-epistemic dynamics. Interventions should target not only individuals, but the dysfunctional social conditions that give rise to the pervasive and enduring phenomenon of conspiracy theory belief. (shrink)
